Sinopsis

Brazilian public administration has undergone several management transformations, from patrimonialist administration to bureaucratic administration, and now to managerial administration, with a view to becoming more efficient and providing high-quality public services. This administration then turned to outsourcing, which is widely practised in private organisations when they work with partners and wish to achieve excellent organisational performance, with the main focus on the performance of core business activities. However, its applicability in public administration raises questions about the legality of this process in public services. This stems from the extent to which outsourcing reduces costs and achieves the legal precept of public efficiency. It is also worth noting the precariousness of work as a negative effect of outsourcing, which ultimately inhibits workers? guarantees. Therefore, it is necessary to debate the process of outsourcing in public administration, especially the legal aspect that deals with the prevailing criteria of this employment relationship.
