This book examines the national territorial jurisdiction of the Cour de cassation and its impact on the effectiveness of the right of access to justice in the DRC. Although the Court of Cassation is a single jurisdiction located in Kinshasa, this centralization creates major obstacles for litigants in the provinces: travel costs, slow file transmission, geographical inequalities and institutional limitations.Based on a rigorous analysis of Congolese law, the author demonstrates that this organization, although legal, puts to the test the constitutional principles of equality before the law, the natural judge and the right to an effective remedy. The book proposes realistic avenues for reform - digitization of procedures, provincial liaison offices, improved procedural guarantees - in order to make cassation justice truly accessible to all.This work offers an in-depth look at the challenges and prospects of access to justice in the DRC, and is a useful reference for students, researchers and legal practitioners.
